SLO Transit has updated its Title VI Program Plan Update for Federal Fiscal Years 2026–2028. The Title VI Program Plan outlines strategies to ensure fair access to transit services. Public input will help shape the update and ensure no one is excluded based on race, color, or national origin.

Two public meetings were held on Wednesday, June 11, 2025, to present and discuss the Title VI Program Update. The presentation outlined key details of the plan.

Title VI of the Civil Rights Act of 1964 states: “No person in the United States shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.”

The Limited English Proficiency (LEP) Plan has been prepared to address the responsibilities of the City of San Luis Obispo Transit (SLO Transit) as a recipient of federal financial assistance as they relate to the needs of individuals with limited English language skills. The plan has been prepared in accordance with Title VI of the Civil Rights Act of 1964, Federal Transit Administration Circular 4702.1B dated October 1, 2012, which states that no person shall be subjected to discrimination on the basis of race, color or national origin.

Executive Order 13166, titled Improving Access to Services for Persons with Limited English Proficiency, indicates that differing treatment based upon a person’s inability to speak, read, write or understand English is a type of national origin discrimination. It directs each federal agency to publish guidance for its respective recipients clarifying their obligation to ensure that such discrimination does not take place. This order applies to all state and local agencies which receive federal funds.

As a federal recipient of public funds, SLO Transit is committed to the FTA's desire for minority and/or women owned businesses, known as Disadvantaged Business Enterprises (or DBE's), to have equal access and opportunity to contracts paid for with these public funds.

On October 3, 2025, the USDOT issued an Interim Final Rule (IFR) regarding its Disadvantaged Business Enterprise program. As outlined in the USDOT guidance, the IFR removes the presumption that women and members of certain racial and ethnic groups are socially and economically disadvantaged for purposes of the DBE program. Under the IFR, an owner of a DBE must now demonstrate on a case-by-case basis that they meet the criteria to qualify as socially and economically disadvantaged under the program and the presumption under the prior rule no longer applies.

The IFR and USDOT guidance state that each Unified Certification Program (UCP) must reevaluate the eligibility of existing DBEs. Additionally, the IFR states that until a UCP completes the reevaluation process, recipients may not include DBE contract goals or count any participation toward overall DBE goals. The IFR provides that until a UCP completes the reevaluation process, recipients shall not be subject to the DBE compliance provisions.

During the temporary suspension, there will be:

• No contract goals
• No Good Faith Effort Documentation
• No counting of DBE participation
• No monitoring of DBE program compliance
• No DBE forms submission

Overall DBE goal setting for FY 2026 and beyond will be developed under the revised § 26.45 requirements once re-evaluations are complete. Until then, no new DBE contract goals will  be established on federally funded projects.
