STORMWATER SPECIFIC

Title 12 - STREETS, SIDEWALKS AND PUBLIC PLACES

12.08.010 Draining rainwater from property onto sidewalk prohibited—Rainwater to be directed into gutter.

No rainwater leader drain, pipe or conduit shall be so erected, placed or maintained as to convey, carry or discharge any water on or to any sidewalk in the city, but all leaders, drains, pipes and conduits conveying, carrying or discharging water to or beyond the exterior boundary of the lot or premises on which the same is erected, placed or maintained, must be led under the sidewalk to the gutter. (Prior code § 7320)

 

12.08.020 Draining rainwater from buildings onto sidewalk prohibited.

No person shall erect or maintain any rainwater leader, drain, pipe or conduit so that the same conveys, carries or discharges any water onto any sidewalk in the city through or by means of any leader, drain, pipe or conduit maintained, placed or existing on or attached to any building or structure owned by or in the possession of or under the control of such person. 12.20.040 Rules and regulations applicable in city parks.

The following rules and regulations apply in all parks in the city, unless expressly stated otherwise elsewhere in this chapter.

 

D. Duty to Care for Animals. It shall be the mandatory duty of all persons owning, possessing, in control of, or otherwise responsible for a dog, a cat, or an equine animal in a city park to promptly collect, pickup and remove all fecal matter left by the animal in or upon the park; provided, however, that this subsection shall not apply to animals properly in the park under the provisions of subsections C1, C2 and C7 of this section, or to guide dogs for blind or disabled persons.

Chapter 13.08 - SEWERS1

 

13.04.010 Statement of policy.

 

The city will furnish water service in accordance with the regulations contained in this chapter and in accordance with other applicable ordinances to any property within the corporate limits and to such areas outside the city limits as the council may designate.

 

In all such cases water shall be supplied only through water meters installed as set forth in this chapter and in each case the customer shall be charged directly for all water passing through the meter, irrespective of the number of users of the water subsequent to its passage through the meter.

 

Applications for service to premises for which a service connection has already been installed may be made as set forth in this chapter. Such application will signify the customer’s willingness and intention to comply with these regulations and to all modifications thereof, and to new regulations or rates duly adopted, and to make payment for water service rendered. Service will be started and discontinued without charge and a deposit may be required to establish credit for regular service.

 

If application is made for service to property where no service connection has been installed, but a distribution main is adjacent to the property the applicant, in addition to making application for service, shall comply with the regulations governing the installation of services. Where an extension of the distribution mains is necessary or a substantial investment is required to furnish service, the applicant will be informed by the utilities department as to whether or not the service can be extended under these regulations as set forth in this chapter. 13.08.130 Stormwater and unpolluted drainage.

 

A. No person shall discharge or cause to be discharged any stormwater, surface water, groundwater, roof runoff, subsurface drainage, uncontaminated cooling water or unpolluted process waters other than to those sewers designated as stormdrains or to a natural outlet approved by the director. Appropriate permits from all affected public agencies may be required by the city and shall be obtained by the applicant.

 

B. No person shall discharge or cause to be discharged any sewage, garbage, rubbish, rubble or otherwise polluted water to any stormdrain or natural outlet. (Ord. 1195 § 1, 1991)

Title 17 - ZONING

Chapter 17.18 - PERFORMANCE STANDARDS*

 

17.18.050 Discharges to water or public sewer system.

A. Discharges to groundwater or waterways, whether direct or indirect, shall conform with the requirements of the Regional Water Quality Control Board and the California Department of Fish and Game.

 

B. Discharges to the city sewer system shall conform to Article II of Chapter 13.08 of this code. (Ord. 1265 § 2 Ex. A, 1994)

GENERAL PROVISIONS

1.12.070 Public nuisances.

In addition to other penalties provided by law, any condition caused or permitted to exist in violation of any provision of this code shall be deemed a public nuisance and may be summarily abated as such by the city, and each day such condition continues shall constitute a new and separate offense. (Prior code § 1206)

1.20.010 Title.

 

This chapter shall be known as the “Appeals Procedure” for the city. (Prior code § 1400)

1.24.010 Purpose—Adoption of administrative guidelines.

 

A. Purpose. The purpose of this chapter is to enable the city, acting as a charter city pursuant to Article XI, Sections 5 and 7 of the State Constitution, to impose and collect civil administrative fines in conjunction with the enforcement of provisions of this code. Notwithstanding the provisions herein, the city has and shall continue to employ the philosophy of voluntary compliance when seeking compliance with this code. Prior to the implementation of the enforcement policies and penalties stated herein, voluntary compliance approaches, when practical, should first be used in order to educate city property owners and businesses concerning the requirements of this code and the corrective action necessary to correct a violation of this code.

 

B. Administrative Guidelines Approved by the City Council. Concurrently with the adoption of the ordinance establishing this chapter, the city shall prepare and promulgate administrative guidelines which shall, among other things, establish policies for providing appropriate and adequate warnings with respect to possible municipal code violations to those persons who may receive an administrative citation, to provide direction to city staff for the correct process of issuing a notice of administrative citation, and to establish the proper format of the notice of administrative citation, and for service of that notice in a manner consistent with the requirements of due process (hereinafter referred to as the “administrative guidelines”). Such administrative guidelines shall be expressly approved by a resolution of the city council prior to their adoption. (Ord. 1426 § 1 (part), 2002)

12.04.010 Encroachment defined.
