Planning Commission Meeting Update

December 14, 2005                    Wednesday                                7:00 p.m.

CALL TO ORDER/PLEDGE OF ALLEGIANCE 

ROLL CALL:      Commissioners Carlyn Christianson, Alice Loh, Andrea Miller, Andrew Carter, Vice-Chair Osborne, and Chairperson Michael Boswell 

Commissioner Christianson was absent. 

OATH OF OFFICE:  Swearing in of new Commissioner, Jason McCoy

ACCEPTANCE OF AGENDA: Commissioners or staff may modify the order of items. 

MINUTES:  Minutes of November 9, and November 30, 2005. Approve or amend.

Minutes were approved as amended. 

PUBLIC HEARINGS: 

1.        1106 Oceanaire Drive. PD and MS 99-05;  Request to amend the existing residential planned development to allow an additional unit in place of the existing recreation room; and tentative parcel map to create a single airspace condominium unit; R-2-PD zone; Larry Smith, applicant.  (Phil Dunsmore) 

On a motion by Commissioner Loh, seconded by Commissioner Carter, the commission voted 6-0 to deny the Planned Development amendment to allow the conversion of the recreation building into a residential unit.  However, the commission offered direction to applicant to apply for a General Plan map amendment and rezone to modify the land use designation from R-2 to R-3 to allow additional residential density that would support the additional residential unit. Commissioners also offered feedback on the appropriate scale of required replacement recreational amenities for the project.  

2.        3210, 3212, 3220, 3230, 3240 Broad Street. GP/R and ER 78-05;  Request to amend the General Plan and zoning maps for the Village Marketplace from Neighborhood-Commercial with a special considerations overlay zone (C-N-S) to Community-Commercial with a special considerations overlay zone (C-C-S); Dan Lemburg, applicant.  (Phil Dunsmore) 

On a motion by Miller, seconded by Osborne, the Commission motioned to recommend approval of the General Plan map amendment and rezone from C-N-S to C-C-S. Prior to the vote, discussion on the motion was focused on the type of office uses that might be appropriate in the center.  A friendly amendment was made to the motion to move three land uses to the Administrative Use Permit Category.  These included Fitness/Health facility, School and Specialized education/training, and Studio- Art, dance, martial arts, music, etc. A second amendment request to allow office uses above the ground floor was introduced by Commissioner Loh. The amendment resulted in a follow-up motion that passed on a 4-2 vote, commissioners Miller and Osborne dissenting. The original motion to recommend approval of the request to the City Council then passed on a 5-1 vote, commissioner Mc Coy dissenting. The motion included allowing Business and Service Offices, Production and administrative Offices and Professional offices on the second floor. 

3.        Citywide.  TA and ER 153-04;  Comprehensive update to the City’s Subdivision Regulations and environmental review; City of San Luis Obispo, applicant.  (Phil Dunsmore)  (To be continued to January 11, 2006)  

This item was continued to January 11, 200, without discussion.

 4.        Citywide.  GPA and ER 149-98;  Review of the October 2005 draft Conservation and Open Space Element of the General Plan to update and consolidate resource conservation policies, including amendments to the Conservation, Open Space, Land Use, Energy Conservation, Circulation, and Water and Wastewater Management Elements; City of San Luis Obispo, applicant. Commissioners took public testimony and focused their discussion on proposed changes to the October 2005 Draft Conservation and Open Space Element (COSE) policies on “open space definitions and standards (Section 8.0), and on proposed General Plan amendments, with particular emphasis on changes to the Land Use Element.  The Commission reviewed proposed amendments to the Land Use Element and made several changes to ensure that open space and conservation policies in the Land Use Element are either carried forward in the new element or preserved in the existing LUE.  The Commission continued its review of the General Plan amendments to a special hearing on January 18, 2006.

6.        Commission 

Commissioner McCoy thanked the Commission for his formal appointment to the Planning Commission.
