CALL TO ORDER/PLEDGE OF ALLEGIANCE
ROLL CALL:

Carter, Jason McCoy, Vice Chairperson Carlyn Christianson, and
Chairperson Andrea Miller
Commissioners Miller and Brown were absent.
ACCEPTANCE OF AGENDA:
The agenda was accepted as written.
MINUTES:
Minutes of June 28, 2006. Approve or amend.
The minutes were approved as submitted.
PUBLIC COMMENT:

PUBLIC HEARINGS:

AP-PC 74-03: Appeal of the Hearing Officer’s approval
to allow a second home on an existing lot; R-1 zone;
Dr. Barry Jones, applicant, Therese Bayly, appellant.

Following
a comprehensive presentation by staff to discuss the history of the
project and the character of the neighborhood, the Commission listened
to public testimony regarding the creek habitat, wildlife corridors
and concerns regarding the scale and mass of the proposed new
residence. Following Commission discussion on the potential biological
concerns, creek setbacks and neighborhood character, Commissioner
Ashbaugh motioned to approve the Use Permit and deny the appeal based
on findings and several additional conditions. The motion included a
condition to increase the creek setback from 20 feet to 30 feet,
recommend the project share one driveway, recommend the ARC reduce the
scale and mass of the new residence, and recommend a riparian habitat
restoration plan be included. Commissioner Stevenson seconded the
motion and commented on the excessive scale of the residence.
Commissioners Mc Coy and Carter felt that the conditions were
excessive and that the proposal already complied with the code. The
motion passed on a 3-2 vote with Commissioners Mc Coy and Carter
dissenting due to the new conditions.

Planning Commission scheduled for Wednesday July 26, 2006 at 7:00 p.m.
in the Council Chamber of City Hall, 990 Palm Street.
